The False Claims Act (or FCA) is one of the Federal government’s favorite weapons in the fight against fraud, waste, and abuse, in the field of government grants. Despite having a history stretching back more than 150 years, the FCA remains an important enforcement mechanism employed by both Federal agencies and private whistleblowers. During this session, you will learn about the history of the Federal False Claims Act and its current uses. As part of the discussion, you will also learn about the legal bases and theories of FCA liability and the potential penalties. In addition, this session will review recent cases as well as related developments under the False Claims Act. Finally, you will learn how grant-funded organizations can avoid liability under the FCA. After attending, you will be able to identify the elements of an FCA claim and outline steps to prevent False Claims Act liability.
